Obras ilegales de ampliación de vivienda y de ejecución de piscinas

Obras ilegales en elementos comunes de las Comunidades de Propietarios En el despacho recibimos muchas consultas relativas a los procedimientos sancionadores y de restauración de la legalidad urbanística incoados contra las Comunidades de Propietarios debido a obras en la cubierta del edificio. Estas obras suelen ser realizadas por vecinos en su propio beneficio sin la preceptiva autorización administrativa, pero sin embargo son responsabilidad de la Comunidad de Propietarios dado que la cubierta es un elemento común del edificio. En numerosas ocasiones, las obras se ejecutan sobre terrazas o cubiertas, que aún siendo un elemento común del edificio, su uso y disfrute es privativo de un propietario, lo que hace que se genere cierta confusión sobre lo que se puede o no hacer por aquel en dicho suelo. La Ley del Suelo de la Comunidad de Madrid responsabiliza a la propietaria del suelo en el que se han ejecutado las obras ilegales, pero si a ello añadimos que las obras han sido autorizadas por la Comunidad de Propietarios, será más difícil que esta se exima de toda responsabilidad ante la administración actuante. Es en el artículo 205.2 de la Ley del Suelo de la Comunidad de Madrid donde se establece que será también responsable de las infracciones el propietario del suelo, de manera solidaria y subsidiaria, ya que en su primer apartado se refiere a los promotores y constructores de dichas obras o instalaciones ilegales. En estos casos, y dado que el procedimiento de restauración de la legalidad urbanística tiene como fin último la demolición de lo construido cuando las obras no pueden legalizarse, el mismo debe ser incoado y notificado al promotor de la obra a efectos de que pueda ejercer su legítimo derecho de defensa. Ampliación de los plazos de caducidad de las obras ilegales en Castilla La Mancha Los nuevos plazos que deben tener en cuenta los castellano-manchegos si han realizado obras sin la preceptiva licencia administrativa son 5 años para suelo urbano y 8 años para suelo rústico. Desde la entrada en vigor de la Ley 1/2021, de 12 de febrero, de Simplificación Urbanística y Medidas Administrativas el plazo del que dispone la administración para incoar el correspondiente expediente administrativo de restauración de la legalidad urbanística ha sido incrementado, por lo que frente a los 4 años que establecía la LOTAU, ahora la administración dispondrá de 5 años para requerir al administrado en el caso de que las obras se hayan realizado en suelo urbano, y un plazo de 8 años si se han realizado en suelo rústico. Las únicas obras que no están sujetas a plazo, son las que se realicen en suelo rústico de especial protección, es decir, que los ayuntamientos pueden incoar el expediente de restauración de la legalidad en cualquier momento, sin límite de tiempo. ¿Y a qué obedece esta ampliación de los plazos? El fin perseguido por esta modificación es la protección de la legalidad urbanística. La actuación de los ayuntamientos pretende la legalización de las obras, si estas pueden ser amparadas por una licencia, o la demolición de lo construido, en caso contrario. La Ley 1/2021 establece que a su vez un mayor plazo para dictar resolución en los expedientes de restauración de la legalidad y sancionador, pasando de los 6 meses que establecía el Reglamento de Disciplina Urbanística del Texto Refundido de la Ley del Suelo al plazo de 1 año.
